Terms of Use

1. Who we are and acceptance of these Terms

This website, italyplanner.com (the "Site"), is operated by [COMPANY LEGAL NAME], [ADDRESS], VAT [VAT] ("ItalyPlanner", "we", "us"), part of the TourLeaderPro.com network of licensed Italian tour guides. By accessing or using the Site you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site.

These Terms are drafted in English. They do not affect any mandatory rights you enjoy as a consumer under the laws of your country of habitual residence, including under Directive 2011/83/EU (Consumer Rights) and, where applicable, United States federal and state consumer protection law.

2. Nature of the Service — we are an information and referral platform

The Site provides editorial travel information about Italy (guides, itineraries, comparisons) and displays links to third-party providers of travel services such as tour operators, ticket sellers, accommodation platforms, transport providers, insurers and telecom providers (each a "Seller").

Important. Except for the professional planning services described in Section 5, ItalyPlanner does not sell, resell, organize, package, bundle or facilitate travel services. When you click through to a Seller, any resulting contract is concluded exclusively between you and that Seller, under the Seller's own terms, prices and cancellation policies. We are not a party to that contract, we do not process your booking payment, and we do not act as a travel agency, tour operator, or as an "organizer" or "retailer" of package travel or linked travel arrangements within the meaning of Directive (EU) 2015/2302.

References on the Site to prices, availability, schedules, ratings, inclusions or duration of third-party services are indicative editorial estimates only and are superseded by the information shown by the Seller at checkout.

3. My Trip tool

The "My Trip" feature stores your selections locally on your device (browser local storage). It is a planning aid only: it does not reserve, hold, purchase or guarantee any service, price or availability. Totals shown are non-binding estimates. Deleting your browser data deletes your list; we do not maintain a copy.

3-bis. User accounts

You may create a free account to save your My Trip selections, guides and notes and access them across devices. You must provide a valid email address you control; sign-in is by one-time code sent to that address (or by an optional password you set). You are responsible for keeping access to your email account secure and for all activity under your account. One account per person; accounts are personal and non-transferable. We may suspend or delete accounts used abusively, fraudulently, or in breach of these Terms, and we may delete accounts that remain empty and unused for over 24 months after notice. You can delete your account at any time from the dashboard; deletion is immediate and irreversible. Account data is handled as described in our Privacy Policy (Section 2-bis). Optional travel-tips emails require your separate consent and can be stopped at any time. The account service is provided free of charge, "as is", and we may modify or discontinue it with reasonable notice, in which case you will be able to retrieve your saved data.

4. Affiliate relationships

We participate in affiliate programs (including, without limitation, GetYourGuide, Viator, Tiqets, Travelpayouts partner brands and others). If you purchase from a Seller after following a link from the Site, we may earn a commission at no additional cost to you. This compensation never determines our editorial judgments. 5. Professional planning services (paid)

We offer paid services performed by licensed guides of our network: (a) Itinerary Review (currently €49): written review of your self-made plan with a follow-up call; (b) Custom Itinerary (currently €249): a bespoke day-by-day plan including up to two revision rounds; (c) Private Guided Days (from €390 per day): private guiding services quoted individually and confirmed in writing before any commitment.

Prices are stated inclusive of applicable VAT unless otherwise indicated, and may change; the price confirmed to you at order applies. Deliverables are informational consultancy: entrance tickets, transport and other travel services remain contracts between you and the relevant providers.

If you are a consumer in the EU/EEA/UK you have a 14-day right of withdrawal from distance contracts. For digital deliverables you may expressly request immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully performed. For Private Guided Days, the cancellation terms stated in your written quote apply; leisure services scheduled for a specific date may be excluded from the withdrawal right under Art. 16(l) of Directive 2011/83/EU.

6. Third-party program changes

Sellers and tour operators may modify, reschedule, curtail or cancel their services (including itineraries, departure times, inclusions and meeting points) at any time, including for weather, safety, strikes, regulatory action or other operational reasons. Such changes are governed solely by your contract with the Seller. ItalyPlanner assumes no responsibility or liability for them; your remedies (refund, rebooking, compensation) lie against the Seller under its terms and applicable law, including, where applicable, EU passenger-rights regulations.

7. Intellectual property

All editorial content of the Site (text, structure, design, graphics, logos, code) is owned by us or licensed to us and is protected by copyright and other laws. You may view and print pages for personal, non-commercial use. Any other reproduction, scraping, text-and-data-mining for AI training, or redistribution requires our prior written consent. Third-party trademarks (including Seller names) belong to their respective owners and are used for identification only.

8. Acceptable use

You agree not to misuse the Site, including by: interfering with its operation; circumventing technical measures; introducing malicious code; harvesting data; framing or misrepresenting affiliation; or using content to train machine-learning models without consent.

9. Disclaimer of warranties

The Site and its content are provided "as is" and "as available". To the fullest extent permitted by applicable law we disclaim all warranties, express or implied, including accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement. Travel information changes frequently; you are responsible for verifying material information (opening days, prices, entry requirements, safety conditions) with official sources and the Seller before relying on it.

10. Limitation of liability

To the fullest extent permitted by law, ItalyPlanner shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of enjoyment, missed connections, program changes, cancellations, denied entry, or losses arising from your dealings with any Seller. Our aggregate liability for claims relating to the Site shall not exceed the greater of (a) the amounts you paid us for paid services in the twelve months preceding the claim, or (b) €100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or your non-waivable statutory consumer rights.

11. Force majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, civil unrest, acts of authorities, failures of networks or hosting providers.

12. Indemnification

You agree to indemnify us against claims by third parties arising from your breach of these Terms or misuse of the Site, except to the extent prohibited by applicable consumer law.

13. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer resident in the EU/EEA, you also benefit from mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. For all other users, the courts of Rome, Italy have jurisdiction, without prejudice to mandatory consumer venues.

14. Changes, severability, contact

We may update these Terms; the version published on this page applies from its "Last updated" date. If any provision is held invalid, the remainder stays in effect. Contact: [EMAIL].
